QDROs & High-Asset Divorce
Pensions, 401(k) holdings and other employer-provided retirement assets can constitute a significant percentage of the total marital property subject to property division in divorce. To ensure both spouses receive a fair amount of these holdings, a QDRO can be established.
In a QDRO, an alternate payee must be identified. This person can be the spouse, ex-spouse, child or dependant of the plan member, and is entitled to his or her share of the retirement plan holdings.
If the plan member was enrolled in the plan after getting married, each spouse's share of the holdings is typically 50 percent. If the member was enrolled in the plan prior to getting married, the holdings will be divided based on the amount earned prior to marriage, the amount earned after and other factors.
